Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Gutman mobile application and related services (collectively, the "Service") provided by RajaPrabha LLC ("Gutman," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. By using Gutman, you represent that you meet this requirement and that the information you provide is accurate.
2. Your Account
- You can create an account using Sign in with Apple, Google, or an email address and password.
- You are responsible for safeguarding your credentials and for all activity under your account.
- You agree to provide accurate profile information and to keep it current.
- Notify us promptly of any unauthorized use of your account.
3. What Gutman Does
Gutman lets you log meals by photo, text, or voice; provides AI-generated nutritional estimates; tracks your intake against configurable goals; offers progress analytics and AI coaching; and optionally reads certain metrics from Apple Health. Features may change, improve, or be discontinued over time.
4. Not Medical or Nutritional Advice
Gutman is an informational and educational tool, not a medical device or a substitute for professional advice.
- Nutritional values, portion estimates, and AI coaching are approximations generated by automated systems and may be inaccurate or incomplete.
- Content related to health conditions (for example, diabetes, IBS, or other conditions you choose to enter) is provided for general informational purposes only.
- Always consult a qualified physician, registered dietitian, or other healthcare professional before making decisions about your diet, health, or treatment. Never disregard professional medical advice or delay seeking it because of something in the Service.
- If you have a medical emergency, call your local emergency number immediately.
5. AI-Generated Content
The Service uses third-party artificial intelligence models (including Google Gemini) to analyze food descriptions and images and to generate coaching responses. AI output can be wrong, biased, or inconsistent. You are responsible for evaluating the accuracy and suitability of any AI output before relying on it.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Attempt to access, tamper with, or use non-public areas of the Service or our systems;
- Reverse engineer, decompile, or attempt to extract source code or credentials, except as permitted by law;
- Upload content that is unlawful, infringing, or harmful, or that you do not have the right to submit;
- Interfere with or disrupt the integrity or performance of the Service;
- Attempt to circumvent rate limits, security controls, or usage restrictions.
7. Your Content
You retain ownership of the content you submit (such as meal descriptions, photos, and messages). You grant us a limited, non-exclusive license to process, store, and use that content solely to operate and improve the Service for you, including transmitting it to the third-party processors described in our Privacy Policy. You are responsible for the content you submit and represent that you have the rights to submit it.
8. Third-Party Services
The Service relies on third parties, including Amazon Web Services (hosting and storage), Google (authentication and AI processing), and Apple (Sign in with Apple and HealthKit). Your use of those features may also be subject to the third party's terms and privacy practices. We are not responsible for third-party services.
9. Privacy
Your use of the Service is subject to our Privacy Policy, which explains what we collect and how we use it. By using the Service, you consent to those practices.
10. Account Deletion
You may delete your account from within the app. Deletion is processed as a soft-delete with a grace period (currently 30 days); if you sign back in during that period, deletion is cancelled. After the grace period, your associated data is permanently removed from our systems as described in the Privacy Policy. Some records may persist in backups or as required by law for a limited time.
11. Subscriptions and Payments
If paid features are offered, the applicable prices, billing terms, and renewal and cancellation policies will be presented at the point of purchase and processed through the Apple App Store.
12. Intellectual Property
The Service, including its software, design, and trademarks, is owned by Gutman and its licensors and is protected by law. These Terms do not grant you any rights to our trademarks or branding.
13. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any estimate or AI output will be accurate.
14. Limitation of Liability
To the maximum extent permitted by law, Gutman and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the Service. Our total liability for any claim will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD $50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless Gutman and its affiliates from any claims, damages, or expenses arising from your misuse of the Service or violation of these Terms, to the extent permitted by law.
16. Changes to the Service or Terms
We may modify the Service or these Terms. If we make material changes, we will provide reasonable notice (for example, in-app or by email). Your continued use after changes take effect constitutes acceptance.
17. Termination
We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. You may stop using the Service at any time.
18. Governing Law and Disputes
These Terms are governed by the laws of The State of Delaware, USA, without regard to conflict-of-laws rules.
